Acceptance of Terms
By creating an account or using PayStaff, you agree to be bound by these Terms of Service. If you're using PayStaff on behalf of a business, you're confirming you have authority to accept these terms for that business.
Accounts & Eligibility
PayStaff accounts are intended for Australian businesses engaging Filipino freelancers or remote professionals, and for the Filipino professionals working with them. Clients must be a registered business or sole trader in Australia; professionals must be at least 18 years old and legally able to provide services as an independent contractor under Philippine law. PayStaff may decline or suspend an account that does not meet these criteria.
Description of Services
PayStaff provides workforce onboarding, verified work tracking through SIPAG, automated invoicing, and cross-border payment routing between Australian clients and Filipino professionals, as described throughout this site. PayStaff is a technology platform; funds are held and transferred by our licensed banking and payment partners, not by PayStaff directly.
Payments & Fees
Fees applicable to payment processing and currency conversion are described on the Fees & Exchange Rates page and confirmed for your account at the time of quote, in line with the plan selected on our Pricing page. Invoices are funded in AUD and paid out in PHP at the rate shown at the time of conversion. Failed payments are returned to the client’s funding source and the related invoice reverts to “Approved” status for re-funding. PayStaff does not charge a refund fee for payments that fail before reaching the professional.
User Responsibilities
Clients are responsible for the accuracy of approvals they make and the legality of their engagement of Filipino professionals, including correct classification of the working relationship. Professionals are responsible for the accuracy of information they submit, including invoice details and payout information.
PayStaff does not determine whether a given engagement should be structured as a contractor or employment relationship — that determination remains with the client, informed by their own legal advice.
Disputes & Adjustments
Disputes over hours, work quality, or invoiced amounts are handled through PayStaff Protect, using the work evidence and approval history recorded for the relevant period. A dispute must be raised within 14 days of an invoice being approved. This process does not replace either party’s legal rights.
Liability
To the maximum extent permitted by Australian law, PayStaff’s liability for any claim arising from use of the platform is limited to the fees paid to PayStaff for the transaction giving rise to the claim in the 12 months prior. Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded under the Australian Consumer Law.
Changes to These Terms
PayStaff may update these terms from time to time. Material changes will be communicated by email at least 14 days before they take effect, and will be summarised at the top of this page. Continued use of PayStaff after that date constitutes acceptance of the updated terms.
